RENTAL AGREEMENT TERMS AND CONDITIONS FOR RENTALS IN LITHUANIA
| DEFINITIONS: |
Lessor – “Eurolitcar Ltd.” - an official representative of an international car rental company “Europcar” in Renter – an individual or legal person of the Renter’s representative – the employee or attorney of a legal person of the Additional driver – an individual authorized to drive the Vehicle by the Lessor on the Renter’s verbal request. Legal tenant of the vehicle (LTV) – the Renter or attorney of a legal person (if the Renter is a legal person) and additional driver. Rental period – the period from check-out (date and time) to check-in (date and time). Vehicle condition – scratches, blemishes and other defects of the Vehicle at the check-out and check-in, indicated in the Rental Agreement. Insurance “road accident” (CDW) – insurance in case of vehicle incident (road accident), natural disaster, third parties’ intentional deed. Super insurance “road accident” (SCDW) – additional insurance in case of the vehicle incident (road accident), natural disaster, third parties’ intentional deed. Insurance “theft” (TW) – insurance in case of vehicle theft. Accident covered by insurance – the following accidents registered at the traffic police station, which happened not for driver’s (LTV) or passengers’ intentional deed or heavy negligence: road accident, theft, natural disaster, third parties’ intentional deed. Accident not covered by insurance – incautious or intentional damage to the Vehicle, its parts or supplementary inner or outer equipment, loosing Vehicle’s documents, keys; accidents not registered at the traffic police station, such as: road accident, theft, natural disaster, third parties‘ intentional deed; road accident made by the driver (LTV) influenced by the alcohol, drugs or toxic materials; road accident, when the Vehicle was driven not by its Legal tenant; road accident occurred on the territory not indicated on the Rental Agreement; theft accident, when the Renter does not present to the Lessor the registration documents, keys and distance control desk of the stolen Vehicle; a technical breakdown due to LTV’s fault. Damage – loss made during the accident covered or not covered by insurance. |
LEGAL TENANT’S OF THE VEHICLE (LTV) RIGHTS AND OBLIGATIONS: |
1. | At the check-out time LTV must present the following valid documents: passport or identification (ID) card and driving license. Driving license must be printed in Latin letters. |
2. | LTV must use the Vehicle in the territory indicated in the Rental Agreement. In case of breakdown of the Vehicle, road accident or other circumstances occurring outside of the territory indicated in the Rental Agreement, Lessor’s assistance services will be unavailable. The Renter must cover all expenses emerging in these cases. |
| 3. | While on the road, LTV must: use the Vehicle expediently and in accordance with the purpose; leave the Vehicle at the safe parking place, locked and with an alarm system turned on; use the fuel only of the type and octane number indicated in the Rental Agreement. |
| 4. | LTV must not: re-rent the Vehicle or its part; permit any third person to use the Vehicle without a written Lessor’s consent; use the Vehicle for giving a charged lift to a passenger; use the Vehicle to take another vehicle on tow; use the Vehicle for illegal purposes; use the Vehicle for race or for driving instructions; to have more passengers than it is indicated in specifications of the Vehicle. |
| 5. | LTV must: not leave the keys, documents and removable Vehicle equipment in The Vehicle; preserve the tires of the Vehicle. LTV undertakes to make restitution to the Lessor for the damage of the tire, loss of the keys, the documents, and the removable additional equipment of the Vehicle. |
| 6. | LTV must inform the Lessor in case the Vehicle is not roadworthy (actual breakdown, supposed breakdown, other reasons); in case of gaining information the Vehicle may be destructed, lost or damaged; in case of loss, damage or destruction of the keys and the documents of the Vehicle. |
| 7. | LTV must return the Vehicle at the agreed time. In case of delay to return the Vehicle, LTV must report no later than 3 (three) hours after the expiry of the Rental Agreement. |
| 8. | If the Vehicle is returned unrefueled, the Renter undertakes to pay a fixed fee for every missing liter. If the Vehicle is returned with complementary items of the Vehicle (first aid kit, emergency sign, etc.) missing, the Renter undertakes to cover all the costs. |
| 9. | In case of the following accidents: road accident, theft, natural disaster, third parties’ intentional deed, LTV must call the traffic police, receive a confirmative document of an accident, take all the necessary measures to protect the Vehicle according to his/her possibilities and inform the Lessor immediately. |
| 10. | LTV undertakes to make restitution to the Lessor amounts for the damage done to the Vehicle and for its loss. The damage done to the Vehicle is determined according to the specified damages at the time of the check-out and check-in. The Renter’s financial responsibility (restitution) to the Lessor amounts to the sum indicated in the Rental Agreement, if the damage caused by the accident is covered by insurance and the Renter agrees to pay road accident insurance (CDW) and theft insurance (TW) at the time of check-out or both are included into the rental cost. To reduce the financial responsibility (restitution in case of the vehicle incident (road accident) covered by the insurance, LTV must pay for the additional insurance (SCDW) at the time of check-out. LTV undertakes to make full restitution to the Lessor (it must not be less than indicated in the Rental Agreement) in case of the accident covered by the insurance (if the Renter refuses to pay road accident insurance (CDW) and theft insurance (TW) at the time of check-out and in case of the accident not covered by the insurance. The Renter undertakes to make restitution for the damage done to third parties. |
| 11. | The Renter must pay to the Lessor the amount that consists of: Vehicle rental amount, additional charges, fees for additional services provided, fines and damage costs as it is indicated in the Rental Agreement. The Renter must pay with the mean of payment indicated in the Rental Agreement. |
| 12. | The Renter undertakes to pay all the fines and cover all other costs associated with traffic, customs and other rules violations. |
| 13. | In case of leaving the territory of the Republic of Lithuania it is essential to have the mandatory Third Party Liability insurance (“the Green Card”) of the countries to be entered, where the Third Party Liability insurance (“the Green Card”) provided by the Lessor is not valid. The Renter must cover any damage done to third parties, all the fines and other costs associated with the absence of the mandatory Third Party Liability insurance (“the Green Card”) of the countries entered. |
LESSOR’S RIGHTS AND OBLIGATIONS: |
| 1. | The Lessor commits itself to rent out the Vehicle clean, with full tank of fuel and in good technical condition. |
| 2. | In case the Vehicle is not roadworthy during the rental period, the Lessor commits itself to change it to another vehicle that is in good technical condition. |
| 3. | The Lessor commits itself at the time of check-out to provide the Third Party Liability insurance valid in the |
| 4. | The Lessor shall not be held liable for damage or loss of any property carried in the Vehicle during the rental or left in the Vehicle after the check-in. |
| 5. | The Lessor has the right to: require the Vehicle back in any case of illegal occupancy; eliminate any obstacles to operate the Vehicle; in both cases, require the LTV or ascertained person to make restitution. |
